Terms and Conditions
Boost Barn will accept returns, cancellations, or exchanges at their discretion for most items that are brand new in the box or original packaging within 30 days of the purchase date, and will be subject to a restocking fee which will vary depending on the product (5%-30%). Products with a shorter return or exchange period will be indicated on the product page or confirmation email. Shipping costs are non-refundable on returns, the cost of shipping items back is the responsibility of the customer. Special order items do not apply and will be final sale only. All Seibon products, all seats (any brand), and all wheels (any brand) are final sale unless otherwise indicated by Boost Barn. All refunds will be issued upon inspection of returned items to ensure they are unopened and unused. Cancellations subject to minimum 5% fee unless otherwise noted by Boost Barn.
There are NO refunds or exchanges on open box, clearance, over-stock, or special order items.
If any parts are damaged, damaged in shipping, defective, or have any other issues it is the customer/client's responsibility to inform Boost Barn immediately upon receiving the product to begin any manufacturer's warranty or shipping insurance claim in a timely manner. Shipping damage must be reported within 24 hours of delivery or an insurance claim may not be accepted (at insurer's discretion after that up to 5 days). Insurance and any shipment/content damage claims will be guaranteed denied if shipment damage is not reported within 5 days of delivery. Incorrect items must be reported within 7 days of delivery, after that Boost Barn is no longer responsible for exchange or incorrect item. For shipping damage you must keep any boxes/packaging and include pictures of that and the damaged product for the claim.
Service - Parts Removed/Remaining
All stock and aftermarket parts removed and/or left after any service must be picked up within 2 days of the service completion or they will be disposed of. It is your responsibility to request these back immediately if you would like to keep them, we will not store them.
Personal information we collect
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.
We collect Device Information using the following technologies:
- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, PayPal information, and e-transfer information), email address, and phone number. We also collect information if you choose to sign up for our email newsletter or an online account. Information we may collect for this includes your name, email address, shipping and billing addresses, phone number, and vehicle information. This is collected to expedite your check-out process when you already have an account with us. We refer to this information as “Account Information”.

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We share your Personal Information with third parties to help us use your Personal Information, as described above. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

SECTION 13 - OFF-ROAD USE ONLY PRODUCTS AND EMISSIONS REGULATION:
Unless explicitly stated otherwise, all products sold by Boost Barn Motorsports Inc. are designated Race Only and are solely for competition/off road use limited to racing formally sanctioned by a recognized racing organization. Any other use, including recreational off-road use, may be in violation of local, provincial/state, and Federal laws. Boost Barn Motorsports Inc. does not implicitly or explicitly confirm the legality of using any products it sells on public roads; that is entirely the responsibility of the consumer. Boost Barn Motorsports Inc. tries to make this information available whenever possible, but when in doubt, clients should review the legality of products prior to purchase.
SECTION 14 – PRODUCT & SERVICE WARRANTIES; LIMITATION OF LIABILITY:
There is NO WARRANTY on any tunes, street tunes, or protunes. There are far too many variables with each vehicle, parts installed, work done, etc. for it to be viable for any warranty. Boost Barn Motorsports Inc., its shareholders, employees, and any related parties are not liable for any damages due to a tune. Boost Barn is not liable for any damages to a vehicle, any parts, motor, or individual during or after any tuning services.
There is NO warranty and Boost Barn is NOT liable for additional expenses or hardship outside of Boost Barn's scope and/or control. This includes but is not limited to: loss of wages, tow bills, vehicle rental or borrowing expenses, daycare, transit, taxi/rideshare, airfare, ferry, etc.
Boost Barn will honour 6 months or 10,000 km (whichever comes first) warranty on labour (excluding electrical work and tunes) and manufacturer's warranty (terms may vary) on parts as long as the following terms are met:
Labour is warrantied only if our installation / service is found to be at fault. For part failure/defects, manufacturer's warranty applies to parts and there will be no warranty on labour when there is no fault on installation. Vehicle must be serviced only at Boost Barn Motorsports Inc. during this time. Oil changes and other services must be completed on time and by Boost Barn Motorsports Inc. Vehicles must not be used for road racing, track racing, drag racing, etc. or they are automatically void of any warranty. Vehicles involved in a motor vehicle accident during this time are void of warranty. Vehicles must not be tampered with for any repairs or modifications by anyone other than Boost Barn Motorsports Inc. Vehicles subject to any extreme conditions or driving may be void of warranty. Approval of a warranty claim does not extend the original warranty period. Boost Barn Motorsports Inc. does not implicitly or explicitly provide any warranties on parts beyond manufacturer's warranty.
Warranty does not apply to any labour or parts if customer supplies parts. Vehicle damage, electrical issues, part failure, labour involved, etc. is not covered if customer provides parts or insists to install parts not meant for the vehicle. Parts are recommended to be purchased from the installer unless otherwise stated by us.
For any engines (short block, long block, etc.) and engine builds, the complete engine block build, installation, break-in, and tuning must be completed by Boost Barn Motorsports Inc. for warranty to apply. Warranty begins as soon as the engine is installed and the vehicle has its first start-up. Engine warranty covers PARTS ONLY (only short block/long block parts - warranty does not extend to any other part of the engine, turbocharger, accessories, or subsequent damage to any component or part of the vehicle due to engine failure). Boost Barn may cover labour for engine tear down if it is determined that the cause was from the build. Otherwise, the consumer will be liable for tear down labour as well. The consumer is liable for all reassembly labour (including fluids and other shop supplies). If you choose to install any parts yourself or take this vehicle elsewhere for break-in and/or tuning, all warranty is null and void. If you (the client/customer) do not prepare the vehicle for break-in/tuning in a timely manner upon engine build completion, warranty will be null and void. This includes having all parts, insurance, claims, payments, etc. ready to commence break-in and tuning. Warranty is null and void for engines in vehicles used for motorsports or other extreme conditions. There is maximum 1 warranty claim allowed per engine build - no subsequent claims will be approved.
JDM VEHICLE BUILDS: Boost Barn Motorsports Inc. does not currently tune JDM vehicles. If your build is for a JDM vehicle, warranty will only apply for 3 months and that is only if a professional tuner has a successful tune on it. If the engine or any other parts have a problem during the tune, there is no warranty. There is no way to confidently determine whether the problem is from the build or the tune itself at that point. If the tune goes well and the vehicle is running healthy after the tune, then regular warranty will apply for 3 months. Boost Barn must still be the ones to build the motor, install it, and do break-in for this to apply. We will also require logs showing the vehicle was running healthy after the tune.
If any parts are damaged, damaged in shipping, defective, or have any other issues it is the customer/client's responsibility to inform Boost Barn immediately upon receiving the product to begin any manufacturer's warranty or shipping insurance claim in a timely manner. For shipping damage you must keep any boxes/packaging and include pictures of that and the damaged product for the claim.
Some exclusions may apply, each claim will be taken at a case by case basis.
SECTION 15 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Boost Barn Motorsports Inc., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some provinces/states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such provinces/states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 16 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Boost Barn Motorsports Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 17 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 18 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 19 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Canada.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
SECTION 22 - TUNING/DYNO DISCLAIMER, RELEASE, AND WAIVER
I agree that I have read and completed the Boost Barn or Bespoke Pre-Tune Checklist and that my vehicle is in a tune ready state. If the tune cannot be completed due to the car not being in a tune ready state, the deposit or hourly rate for that tuning session will be charged. You are purchasing a slot of time on the dyno. If your car cannot be on the dyno due to it not being in the proper running condition, your time is still expiring.
Any parts, chemicals, lubricants, hardware, and/or components used by Boost Barn Motorsports Inc. to successfully complete the dyno session will be at additional cost to the vehicle owner. Any vehicle on the dyno that is in need of repair or modification to complete a successful tuning session will be subject to an additional charge of the regular shop hourly rate to correct the problem before dyno tuning can commence or resume. This charge is in addition to the charge for the dyno time and will be more than the hourly shop rate.
Testing and tuning on the Dyno Dynamics 4WD Dyno will push your vehicle to its mechanical limits. It is your responsibility to ensure that your car is in good working order and capable of handling the stresses incurred when your car’s limits are reached.
Boost Barn Motorsports Inc. is in no way responsible for ANY damages to your vehicle incurred before, during, or after your vehicle is operated on the dyno or road. Any damage caused to the vehicle is the sole responsibility of the vehicle owner. Circumstances can arise on the dyno or the road that are beyond the control of the tuner or Boost Barn Motorsports Inc. and engine failure is a distinct possibility. Boost Barn Motorsports Inc. and its directors, shareholders, employees, and any other related parties take NO responsibility if an engine/drivetrain or any other vehicular part failure occurs.
It is the vehicle owner and any other guests’ responsibility to ensure they are safely distanced from the dyno and work area in the shop. Boost Barn Motorsports Inc. takes NO responsibility for any physical harm or injury due to any party not following safety instructions.
I hereby acknowledge that I am aware of the potential risks involved with dyno testing / tuning and that I waive any and all claims against Boost Barn Motorsports Inc. and its agents for ANY and ALL damage to my vehicle or injury to self as a result thereof.
